PHONE COMPANIES RETAINING DATA

Can anybody direct me to any papers etc that states the phone retailers have to retain a copy of data from handsets when a customer goes into the shop and asks for data to be deleted (heard that they have to retain it by law)
any help would be gratefully accepted
